1. Who we are

appy.agency is a trading name of Pyxage Ltd, a company registered in England & Wales under company number 11232293, with its registered office at 494 Littlemoor Road, Weymouth, Dorset DT3 5NY, United Kingdom (“we”, “us”, “our”).

2. What these terms cover

These terms govern your use of the appy.agency website (including the free AI business analysis tool at /analysis) and any services you purchase from us, including business analysis, prototype development, custom CRM and software builds, and ongoing hosting, maintenance and support subscriptions.

For paid engagements, a written proposal, quote or statement of work agreed between you and us describes the specific scope, price and timeline. If that document conflicts with these terms, the agreed proposal takes priority for that engagement.

3. Our services

  • Free analysis — an initial, no-obligation analysis of your business processes, delivered through our website or a call.
  • Prototype — a fixed-price working prototype of your system, as described in the agreed proposal.
  • Build — development of your custom system for the fixed price agreed in the proposal.
  • Run — an optional monthly subscription covering hosting, monitoring, maintenance and support.

4. Quotes, payment and billing

Prices are stated in the agreed proposal and, unless stated otherwise, exclude VAT and other applicable taxes. Payments are processed securely by our payment provider, Stripe; we do not store your card details. Monthly subscriptions are billed in advance and continue until cancelled.

Invoices are payable within the period stated on the invoice. We may pause work on an engagement while an invoice is overdue.

5. Cancellations and refunds

  • Prototype and build work — you may cancel at any time in writing. You pay for work completed up to the date of cancellation; any prepaid amount covering work not yet performed is refunded.
  • Monthly subscriptions — you may cancel at any time with effect from the end of the current billing period. No partial-month refunds are given unless required by law.
  • If a delivered prototype or build materially fails to match the agreed scope and we cannot fix it within a reasonable time, you are entitled to a proportionate refund.

To cancel or request a refund, email hello@appy.agency. We aim to respond within two business days and to process approved refunds to the original payment method within 10 business days.

6. Your responsibilities

You agree to provide timely access to the information, people and third-party accounts reasonably needed to deliver the engagement, and to make sure any material you give us does not infringe anyone else’s rights.

7. Intellectual property

Once you have paid in full for a prototype or build, you own the deliverables: the source code, data and design created specifically for you. We may reuse general know-how, tooling and open-source components that are not specific to your business, and — with your permission — describe the engagement in anonymized case studies.

Third-party and open-source components included in deliverables remain subject to their own licences.

8. The free analysis tool

The AI analysis tool provides an automated, indicative assessment and quote. It is provided “as is” for information only and does not constitute professional advice or a binding offer; a binding scope and price are only set in a written proposal we both agree.

9. Liability

Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot be limited by law. Subject to that, our total liability arising out of an engagement is limited to the amount you paid us for that engagement in the 12 months before the claim arose, and we are not liable for indirect or consequential losses, loss of profit, or loss of data caused by events outside our reasonable control.

10. Data protection

We process personal data as described in our Privacy Policy. Where we process personal data on your behalf as part of an engagement, we do so on your instructions and will enter into a data processing agreement on request.

11. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place an order applies to that order.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that if you are a consumer, you keep any mandatory protections and venue rights of the country you live in.
